Problem: destitute ex-employee sues famous former employer (- like maybe a YMCA?)

Solution: Simply deny everything & lie?

Problem: The man didn't quit when he couldn't afford a lawyer.

Solution: Hire two big-city lawyers from a huge legal firm & play the game, shrewdly.

Problem: The now-annoying former employee...still didn't give up.

Solution: Withhold evidence, lie some more, behave more shrewdly...and somehow see it all swept under the rug, regardless of the Law, the evidence, the U.S. Constitution / Bill of Rights, & many legal precedents? - Hah!

What happens, America,

...when outright corruption hits our courts?

(And) why is nobody saying anything about that? -- Don't you know you could be next?!

...And WHERE (Oh, where) are our politicians & leaders in all this?

-- Why have none of them, during the term of our first black president, piped up

with solemn words of authority to condemn the travesty & corruption against

poor Mr. Noack in that Noack vs. YMCA case?

WHY? Because its a matter...Of MICE & Men! -- That's why.

The man's case involves claims (by a white man) of blatant discrimination against

blacks & anti-male discrimination, sworn testimony about repeated physical

assaults & ridicule in front of coworkers, apparent theft of documents from a

licensed childcare facility, possible forced unpaid overtime (slavery?),...and more!

America is "served" by a bunch of self-absorbed..."mice" -- false shepherds too

worried about their slice of political fame & power, not serving & doing what's

right. Otherwise,...with all the proof supporting Mr. Noack's case, things would

be much different already, as the poor man (among other things) seems to have

absolutely proven that an enormous YMCA...committed PERJURY.

Documents filed in federal district court in Houston, TX show it. - PERIOD.

What? -- Oh no, there are no "ifs" or "buts" involved.

PERJURY has been proven, by multiple documents filed in court.

What ELSE has been proven? Well,...it seems that evidence clearly reveals

obstruction of justice, fraud, & false statements by the YMCA...and probably

obstruction of justice by multiple judges by now.

There is no other explanation for the gross -- yes GROSS -- amount of judgement in

the case contrary to the facts & evidence, Law, & legal precedents given.

Please forgive the crudeness, but the actions are not accidental. Rather, it seems

more like a bold legal assasination -- sort of like if a hardened killer simply walked up

to someone in broad daylight, on a crowded street,...& coldly blew his brains out.

That,...with people all around ... simply watching, doing nothing (nada)!

- It can become a sad indictment against America & its Politicians & "leaders"!

It has been indicated that the YMCA may have been considering drastic action to get the "monkey" off their backs", regarding the former supervisor of Mr. Noack. That's right, if you know what it means to be figuratively "thrown under the bus", you'll understand.

Or is it the proverbial "volcano sacrifice" routine?! - Yikes!

That's right,...it seems there

may (lol) have been an early attempt to discourage Noack's thrust at justice by the idea that the YMCA could simply claim his boss did everything all on her own, and that if they dumped her, problem solved. (-- Yet, it wasn't all merely her own doing.)

C'mon YMCA, show some guts!

Show some class, & man up to it!

And what else? - How about spy-ing & creeping around in secret?

Yes,...court records show what seems to be employees spying

on Noack after he "allegedly"refused to do illegal acts, etc. for the YMCA. Records also indicate visits by other office staff to most or all of his five licensed afterschool child-care sites...at days & times when he was not there!

One such visit...by Noack's supervisor and some former coworkers (friends of hers) was conducted apparently outside of that particular childcare site's operating hours. Somehow, a reportedly locked cabinet was no obstacle and some state-required documentation went mysteriously missing.

Although the YMCA at first denied anything to do with it, Noack found some eye-witness/s to the clandestine operation, so the YMCA eventually "fessed up" to that in court, but with a few twists Noack regarded as untrue.

Of course, nevermind that the YMCA testimony was contradictory or that part of it has been shown in court to be grossly false, right?

About the Internet Posting of the Circuit Court Ruling

Here is a copy of the recent ruling by the US 5th Circuit Court of Appeals.

HOWEVER,....bear in mind that they have grossly distorted the issues & facts involved -- apparently on purpose, as you will see.

MANY of the facts stated are extremely lacking...or VERY twisted...in a way that highly favors the YMCA.

Certain facts...are not facts at all. -- Rather, they are regurgitations of illegitimate claims & assumptions laid out by the YMCA attorneys in their legal case. There are some that Noack actually proved were untrue, but that the YMCA had apparently so drilled into the brains of the judges by repetition & false citations of Law that the over-worked judges failed to notice they had been snookered (or didn't want to know) as they skimmed through the case to hurriedly make a rendering under the heavy load of cases in the court system.

Do not be deceived: Mr. Noack did NOT present a case before one court after another simply because his feelings got hurt over trivial things. For example, notice the fact tha the court never at all mentioned Noack's sworn testimony about multiple, repeated phsyical assaults in the office (by hand & by thrown objects) & threats of physical assaults (-- all in front of coworkers),...and that the YMCA never denied such things in their case. Oddly, their own prior edict in another opinion set a precedent that previous employer behavior IS proof of intent, malice, etc. So,...they simply ignored their own very recent precedent! That cannot be accidental, can it? I doubt it. (The courts have MANY shrewd shenanigans in this case.)

In one place, the court lied & falsely said Noack never contested the YMCA's use of unnotarized affidavit testimony in district court. That is grossly untrue & merely parrots a desperate YMCA's claim -- shows whom they are really listening to & that they are ot free thinkers but pawns, lol. Noack did contest the matter, and he showed citations to the 5th Circuit Court from the district court records where he had thus opposed the YMCA affidavits as being invalid..for several pages in his case there...and for other reasons of Law also, (including that he proved by documentation YMCA testimony contained perjury.)

The court's twist on Noack's claims also follows the YMCA's lead in a quite perverted way that is hardly noticeable simply by reading their ruling. Noack did not base his claims on merely his own words. No, he proved them. The emails filed as evidence in the case show an actual email conversation where Noack pleaded with his female supervisor to reconsider her stance on positions like illegal discrimination in hiring. His supervisor's response was a simple, straight forward REASON for why she gave such orders -- a reason which Noack proved to the court was, by Law, totally illegal discrimination. So,...even in lying (apparently), the lie was also not a good one. Like a child that twists his/her story while trying to NOT get in trouble, the YMCA got it's foot caught in its own craftiness.

So, too, the words of the court's decision seem carefully crafted for favoritism in a way that tries to make all look normal & innocuous. In the decision, you will see little attention to major facts & issues or even to the real main evidence supportig Noack's case as the 5th Circuit evidently tries to blatantly minimalize & discredit Noack's case. Taking sides - and falsely, so while ignoring the evidence presented -- is NOT justice: it is illegal & prejudicial conduct. Since some of you may search the case or others and see such posts of court decisions, it is hoped that you may be enlightened that such things are mere "letters" of self-justification.

Imagine if you will, the old western movies where someone escaping the Law brushes away their tracks to conceal their trail. That is what these "decisions" seem to be, as corruption & injustice are concealed under rhetoric, truth is craftily skirted & "side-stepped", & facts avoided that might prove their "regal" decision to be utterly wrong. The "Kings" rule from their lofty thrones as they please, and WHO will stop them? If they favor the rich, the influential, or friends,...WHO can or will do anything at all? They mock the USA & our legal system,...because they have found a way to rule it. They have found a way to do as they wish & to get away with it (all too often).
